GENERAL TERMS AND CONDITIONS OF SALE ON OUR WEBSITE
Clause No. 1: Purpose
The general terms and conditions of sale described below detail the rights and obligations of the Association des Nuits Lyriques de Marmande and its customers in connection with the sale of merchandise on its website. Any service provided by the Association des Nuits Lyriques de Marmande therefore implies the buyer’s unreserved acceptance of these general terms and conditions of sale. All the data provided and the recorded confirmation will constitute proof of the transaction. You declare that you are fully aware of this. The order confirmation will constitute signature and acceptance of the transactions carried out.

Clause No. 5: Payment terms
Payment for orders can be made:
• by credit card;
• via PayPal.
When placing an order, the buyer must pay 100% of the total invoice amount.
Clause No. 6: Late payment
In the event that goods are shipped before payment has been made, or in the event of total or partial non-payment for goods delivered on the date of receipt, the buyer must pay the Association des Nuits Lyriques de Marmande a late payment penalty equal to three times the legal interest rate. The legal interest rate applied is that in force on the date of delivery of the goods. As of January 1, 2015, the legal interest rate will be revised every six months (Order No. 2014-947 of August 20, 2014). This penalty is calculated on the basis of the total amount including tax remaining due, and runs from the due date of the price without any prior formal notice being necessary. The Association des Nuits Lyriques de Marmande retains ownership of the goods sold until full payment of the price, in principal and accessories. As such, if the buyer is subject to receivership or judicial liquidation, the Association des Nuits Lyriques de Marmande reserves the right to claim, within the framework of the collective proceedings, the goods sold and remaining unpaid.

Delivery is made:
• either by direct delivery of the goods to the buyer;
• or to the location indicated by the buyer on the order form.

The risk of transport is borne entirely by the buyer. In the event of missing or damaged goods during transport, the buyer must make all necessary reservations upon receipt of the goods. These reservations must also be confirmed in writing within five days of delivery, by registered letter with acknowledgment of receipt.
